Long ago, businesses decided that settling before a lawsuit is a good idea because it prevents unwanted negative attention to the business. Even though the chances would be slim that the plaintiff would win, many companies just add these settlements to the "cost of doing business." It was a bad trend to start, and one that will not see an end because the bean counters determined that X amount of dollars to settle is preferable to potential loss of business due to publicity. The mall knows it is not liable, but it prefers to sweep it all under the rug. Good for the mall and bad for the notice of justice.
